These Terms & Conditions ("Terms") govern your access to and use of apexdesignservices.com (the "Site") and the services provided by Apex Design LLC ("Apex Design," "we," "us," or "our"). By accessing the Site or engaging Apex Design for services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party. You may not use the Site to transmit harmful code, attempt unauthorized access to our systems or accounts, or misrepresent your identity.

Apex Design provides custom website design and development services, including lead generation and marketing websites, ecommerce solutions, and custom WordPress development. Service descriptions on this Site are provided for general informational purposes and do not constitute a binding offer; the specific scope, deliverables, and pricing for any project are defined in a separate written proposal or agreement between Apex Design and the client.

Once a client accepts a proposal and any required deposit is received, Apex Design will begin work according to the agreed scope. Additional requests outside the original scope of work may be treated as a change order and may affect project timeline and cost. Timelines discussed during the sales process are estimates and may shift based on client responsiveness, content delivery, and project complexity.

Upon full payment for a completed project, the client retains full ownership of their hosting, domain, WordPress instance, custom content, and final website deliverables. Apex Design does not retain hosting, domain, or account access rights after final payment unless the client separately enrolls in an ongoing maintenance or hosting plan. Nothing on this Site or in these Terms transfers ownership of any project prior to full payment being received.

Payment terms — including any deposit, installment schedule, and final payment due date — are set out in the individual project proposal or agreement signed by the client. Work may be paused or delayed on accounts with an outstanding balance. Late payments may be subject to additional fees as outlined in the applicable project agreement.

Apex Design provides unlimited revisions during the active design and build phase of a project, and 90 days of free changes following launch, as standard on every website package. Support requests after this 90-day window may be covered under an ongoing maintenance plan or billed separately, as outlined in your project agreement or maintenance plan terms.

All content on this Site — including text, graphics, logos, and design elements — is the property of Apex Design or its licensors and is protected by applicable intellectual property laws, unless otherwise noted. For client projects, custom deliverables (design, code, and content created specifically for the client) become the client's property upon full payment. Apex Design retains the right to use pre-existing tools, frameworks, code libraries, and general methodologies that are not unique to a specific client project, and may showcase completed client work in its portfolio unless otherwise agreed in writing.

This Site, and websites built by Apex Design, may use cookies and third-party tools such as analytics platforms and advertising pixels to support functionality and measure performance. This Site may contain links to third-party websites or services that are not owned or controlled by Apex Design. We are not responsible for the content, privacy practices, or terms of any third-party site, and we encourage you to review the terms of any site you visit.

These Terms are governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law principles. Any disputes arising from these Terms or our services shall be resolved in the state or federal courts located in New Hampshire.

Apex Design may update these Terms from time to time. Any changes will be posted on this page with a revised effective date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
